The Legal Requirements to Get Married in NSW

To legally get married in Australia, you must:

• be over 18 years of age

• not already be married

• give at least one month’s notice

• be married by an authorised celebrant

• have two witnesses over 18

These requirements apply whether you're planning a large wedding or a simple beach elopement.



The Notice of Intended Marriage (NOIM)

One of the most important steps is completing a Notice of Intended Marriage (NOIM).

This is a legal document that must be lodged with your celebrant at least one month before your wedding date.

Key things to know:

• it can be signed up to 18 months before your wedding but not longer.

• it can be signed in person or witnessed remotely

• your celebrant will guide you through the process


Local tip:Many couples leave this too late - organising it early gives you peace of mind and flexibility with your wedding date.


What Documents Do You Need?

To complete your legal paperwork, you’ll need:

• a passport or birth certificate

• photo ID (driver’s licence is fine)

• evidence of divorce or death certificate (if applicable)

Your celebrant will check everything and ensure your paperwork is correct.


What Happens During the Ceremony?

For your marriage to be legally valid, there are a few required elements in the ceremony.

These include:

• specific legal wording spoken by the celebrant

• a legal declaration by each partner

• signing the marriage documents

• two witnesses present


Everything else in your ceremony is completely flexible and can be personalised to reflect your relationship.


After the Wedding

After your ceremony:

• your celebrant lodges the marriage with Births, Deaths & Marriages

• you can apply for your official marriage certificate

• this is the document used for legal name changes
